Rent a car on the Costa del Sol - General conditions
The total amount must be paid on delivery of the vehicle.
We accept the following credit cards: Visa, Mastercard, Eurocard y American Express.
- The rented vehicle will only be able to circulate in the AUTONOMOUS REGION OF ANDALUCIA.
All insurance coverage will be void if vehicle is driven under the influence of alcohol or drugs, in which case the Lessee will be liable for all damages.
- Rental rates include coverage of mandatory motor vehicle insurance and additional civil liebility insurance guaranteeing consequential damages vis-ΰ-vis third parties derived from the use and circulation of vehicles , except Excess (credit card is required as a guarantee for the deposit of the Excess). In order to obtain coverage without Excess, the corresponding premium has to be paid (Excess cover supplement per day).
- These coverages are guaranteed by the Insurer with whom the Lessor has underwritten the corresponding insurance policy and are subject to the terms agreed in the general and private conditions of the said policy.
This policy does not cover any damages, losses, or other harm caused to luggage, merchandise or personal objects transported in the vehicle, nor the total or partial loss in the vehicle due to theft and/or vandalism and/or traffic accident.
- The Excess cover supplement is an optional service rendered directly by the Lessor exempting the Lessee from the economical liability only for damages caused to the vehicle as consequence of the traffic accident, as well as the indemnity of immobilization.
- In case of no-contracting the Excess cover supplement in case of accident, the Lessee will be liable for the Excess as well as for the compensation for immobilization of the vehicle; the estimate for this compensation will depend on the number of days needed for repair of the vehicle, based on the certificate issued by the repair shop, and according to the price agreed on in the contract.
- In no case will Excess or Excess cover supplement cover any kind of damages caused to the underside of the vehicle, the tyres or wheel-rims, whatever their category, if these damages are a consequence of driving the vehicle with an excessive load, surpassing the limits authorized in the vehicle licence and/or in the vehicle data sheet, or if vehicle is driven on beaches, inappropriate roads, forest tracks or mountain trails, etc., which are unauthorized and unpaved roads.
- The Lessee has the obligation to inform ESPACAR within the next 24 hours of any accident or damage caused to the vehicle. The Lessee will likewise take the necessary steps within his reach to avoid greater damages and will be responsible for the consequences of his delay in complying with this obligation.
- The Lessee will fill up on the appropriate type of fuel. Otherwise the Lessee will be liable for towing and/or repair expenses of damages caused to the vehicle by the use of inappropriate fuel.
- The Lessee agrees not to transport more persons than allowed according to the number of seats in the vehicle, nor to participate in races or other competitions. It is understood that the Lessee will be solely responsible for any penalties incurred as a consequence of violating traffic regulations or the non-observance of other laws, and that he will also be held liable for the ulterior consequences of the same.
- The Lessee must hold a current, valid, full driving permit for over two years and be 25 years or above.
- The Lessee will be liable for all legal and extra judicial charges, including lawyers and procurators fees caused by any claim against the non-observance of this Agreement. This Agreement will come into force as per date and departure time stated on the voucher and is signed as a proof hereof. Any litigation between the parties arising out of this Agreement shall be settled in accordance with the jurisdiction of the courts of law in ESTEPONA.
- The Lessee will return the car on the date, place and time indicated in the contract, as otherwise the insurance coverage will be cancelled and the Lessee would be incurring in a possible misappropriation offence according to article 535 of the Penal Code.
